Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that operator of Caterpillar 416C backhoe loader, serial number 4ZNZ4104, kneeling in the seat with the seat facing forward, with the stabilizers in the raised position, and using the backhoe to center the backhoe loader on trailer, Georgia tag number 6074CT, next to golf course on or about May 14, 2001 was exposed to the hazard of being struck by the backhoe loader toppling over the side of the trailer. A feasible and useful method to correct this hazard, among other methods, is to have the operator utilize the seatbelt while sitting in the seat with the seat facing forward and reposition the backhoe loader by slowly and carefully backing up and pulling forward to center the backhoe loader on the trailer with an observer to assist the operator in positioning the backhoe loader on the trailer if an observer is present.
