Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries by not wearing their seat belts while operating fork lifts: (a) Yard area, two employees were observed not wearing their seat belts while operating John Deere 488E fork lifts, exposing them to the hazard of being crushed should the fork lifts turn over. Among other methods, one feasible and acceptable method of abatement is to ensure the use of the seat belts already installed in the units.led
