Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being struck by moving pipe and fittings, in that, on 05-12-00, labor crew was doing a flow back job at a Texaco lease with restrictions in the flow line and an unsecured fitting. The sudden release of energy caused by an CO2 ice plug thawing caused the fitting to fly up into the air striking the victim in the head, fatally injuring him. Among other feasible and acceptable methods to correct this hazard, on feasible method would be to provide for the slow bleeding off of built-up pressure, no restrictions in flow line and secure all pipe and fitting with safety chains or cables.
