Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. Employees mixing caustics on McVay Drilling Rig #10, were not provided with adequate personal protective equipment when mixing caustic materials. The lack of proper personal protective equipment is contrary to the American Petroleum Institutes Recommended Practices 54, which states: Protective gloves, apron, or other protective equipment, as appropriate, should be worn by employees handling chemicals that may irritate or be absorbed through the skin.
