Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to employees in that: a) Monroeville Rd. (Rt. 604) Franklin Twp. N.J. - Employees riding on farm equipment, such as but not limited to, farm field-trailers being pulled by agricultural farm tractors while traveling on public roadsat twilight were exposed to being struck by vehicles on the roadway. On or about 10/31/2002. Among other feasible and reasonable abatement methods to correct the hazard is to follow the requirements as outlined in: a) N.J.S.A. 39: 3-65 - All vehicles including agricultural machinery or implements, road machinery, road rollers, traction engines and farm tractors not herein before in this article specifically required to be equipped with lamps, shall be equipped during the times when lighted lamps are required with at least one lighted lamp or lantern exhibiting a white light visible from a distance of five hundred feet to the front of such vehicle and with a lamp or lantern exhibiting a red light visible from a distance of five hundred feet to the rear, and such lamps and lanterns shall exhibit lights to the sides of such vehicle, AND, b) N.J.S.A. 39:3-46 - "When lighted lamps are required" means at any time from a half-hour after sunset to a half-hour before sunrise; whenever rain, mist, snow or other precipitation or atmospheric moisture requires the use of windshield wipers by motorists; and during any time when, due to smoke, fog, unfavorable atmospheric conditions or for any other cause there is not sufficient light to render clearly discernible persons and vehicles on the highway at a distance of 500 feet ahead.
