Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a)On October 3, 2000, an employee was operating an aerial lift platform where the user did not ensure that before each movement of the platform the minimum safe approach distances to energized power lines and parts (10 feet) were maintained. This condition exposed the operator to contact with energized conductors and/or electrical shock hazards. Reference ANSI A92.5-1992, American National Standard for Boom-Supported Elevating Work Platforms, Sections 10.2.3 and 7.9(f). Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
