Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following condition(s): a) The employer did not provide proper training for an employee using a Bobcat Skid Loader model 743 at a farm supply company and thereby did expose him to the hazard of being crushed by the bucket. Note : Among other methods, some feasible and acceptable methods to correct this problem are: (1) Train employees to never leave the loader with the motor running or with the lift arms up. (2) Train employees to never stand under a raised bucket. (3) Train employees to never operate the controls on the loader from outside the cab. (4) Train employees how to avoid exceeding the rated capacity of the loader. Reference : Bobcat Skid Loader Operation and Maintenance Manual. (b) The employer did not provide proper maintenance for a Bobcat Skid Loader model 743 used by an employee at a farm supply company and thereby did expose him to the hazard of being crushed by the bucket. Note : Among other methods, some feasible and acceptable methods to correct this problem are : (1) Insure that the Bobcat Skid Loader is in good operating condition and that all its safety equipment is correctly installed including a seat bar that locks the pedals when it is raised. (2) Insure that the Bobcat Skid Loader has all the machine signs (decals) in place which instruct the user on how to safely operate the equipment including the one stating "DANGER-Avoid Death-Keep out of this area when lift arms are raised." (3) Insure the Operators Hand Book is fastened to the cab and that the Operation and Maintenance Manual is available at the workplace. Reference : Bobcat Skid Loader Operation and Maintenance Manual.
