Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by a structural steel supporting beam which was not adequately secured and supported laterally to prevent the accidental movement and displacement of the beam. One feasible method among other methods to eliminate the hazard would be to have a professional engineer design a proper installation and support system to prevent the possibility of movement and collapse: Jobsite: Basement level of the future residence: On or about March 27, 2000, employees were exposed to serious injury while installing a structural steel support beam, greater than 37 feet long, and weighing greater than 600 pounds, where the temporary support system consisted of unsecured wooden A-frame supports and unsecured steel lolly columns. The removal of the A-frame supports and a triangular wood brace installed from the wooden sill of the foundation to one of the wooden A-frame supports, caused the steel beam to be displaced and laterally fell from its elevated position to the concrete basement floor below. One employee received fatal trauma to the head when he was struck by this beam.
