North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)jobsite -- on or about 10/22/99, at approximately 11:55 AM, an employee was electrocuted when the boom of a truck mounted telescoping Pitman-Hydra lift serial number 3757- 1778-0119 touched an overhead 14,440 volt power line while the employee was attempting to lift and guide a steel plate weighing approximately 650 lbs., from the lift truck to wooden horses on the ground. The truck was positioned under the power line by an untrained and unlicensed operator who was not qualified as required by ANSI/ASME B30.5(1995). One feasible method, among others, is to train boom truck operators as required by ANSI/ASME B30.5 (1968) 1995 Revisions, Sec.5-3.1
