Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential inhalation of toxic levels of anhydrous ammonia. a)On or about July 20, 2000, a discharge line from the refrigeration system ammonia receiver was located under the walking and working platform for the cooling towers and below the roof level, exposing employees to ammonia vapors when the pressure relief valve vented. Among others, one feasible and acceptable method to correct this hazard is to comply with The American National Standards Institute/International Institute of Ammonia Refrigeration 2, 1992 Edition, Paragraph 5.4.1.2, which states: "The extremity of the relief valve discharge line when relieved to the atmosphere shall be above the roof and not within 20 feet (6.1 m) of any window, ventilation intake or personnel exit".
