T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that, a chain hoist system was in use to pull manufactured homes along a "final finish line." The hoist used a series of chains which when unhooked could become entangled in the movement of the main chain, which likely caused the accident that resulted in the fatality. In addition, the chain had been inadvertently left attached in the past. "Among other methods, one feasible and acceptable abatement method to correct this hazard would be to have stationary "stop stands" installed to prevent the units from coming together."
