North Carolina General Statute 95-129(l) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)establishment- Employees operating Orbit palletizer robot subject to being caught in operating lift arm clamps or struck by moving robot. Employee William Mosley was caught in operating lift arm clamp resulting in mechanical asphyxia on 5-4-99. Acceptable means to abate this include, but are not limited to the following: 1)Provide perimeter guarding around operating envelope of palletizer robot per ANSI R15.06-1992. 2)Provide employee training for robot operation and safety per ANSI R15.06-1992. or in the alternative, 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by moving robot and operating robot lift arms: a)establishment- Employees operating Orbit palletizer robot.
