North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)falling from the tongue/towbar of the Ford agricultural tractor, model 3600, s/n C486744. An employee riding on the tongue/towbar fell and received fatal injuries on September 30, 1998. b)falling from a loaded tobacco trailer, while being transported from the field to the tobacco barns, five employees were exposed to falls from the trailer on and prior to September 30, 1998. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a separate enclosed vehicle to transport the migrant workers.
