Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee, in that employees were exposed to the hazard of falls: (a)Job Site - On March 19, 1999 an employee was exposed to the hazard of falls by operating a chainsaw weighing more than 15 pounds in a pine tree. An employee working as a tree trimmer in a tree was allowed to transport and use a 35 pound Stihl 044 chainsaw attached to a line that was attached to the employee's tree saddle. The chainsaw was not supported by a separate line. (Reference American Nationa Standards Institute (ANSI) Z133.1-1994, for Tree Care Operations - Pruning, Trimming, Repairing, Maintaining, and Removing Trees, and Cutting Brush - Safety Requirements, Chapter 7, Paragraph 7.2.2.) Among other methods one feasible and acceptable method to correct this hazard is to prohibit employees working in trees from transporting and using chainsaws weighing more than 15 pounds, unless the chainsaw is supported by a separate line.
