Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: On or about May 27, 2000, and at times prior to that date, employees were exposed to the hazard of being struck/crushed by over-turning tractor when moving railroad cars by hooking a chain to the railcars and pulling the railcars with a farm type tractor. This method of moving railcars developed a hazardous condition of instability when the pulling tractor was overtaken, without warning, and overturned by the chain secured to the moving railcars. Among other methods, one feasible and acceptable abatement method to substantially reduce this hazard is to ensure all affected employees are trained in the recognition of the hazards associated with the moving of railcars; all railcar spotting personnel are properly positioned and supervised during the moving of the cars; the chain(s) is rigged so that slack breaks the connection; and, the industrial vehicle used is designed to furnish the power to push or pull the intended load. ***Certification and Documentation of Abatement Required***on
