Title 21 V.S.A.Chapter 3, subchapter 5, section 223(a): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: in that the Yale forklift equipped with an overhead guard was not provided with an operator restraint system, as indicated by the Yale Operator's Restraint Program, dated September 19, 1990. Location: Driveway Violation: The Yale 2500 pound capacity forklift, equipped with an overhead guard,was not provided with seat belts designed to restrain the operator within the confines of the protective cage. Among other methods, one feasible and acceptable abatement method to correct this hazard is to insure that seatbelt retrofit kit is installed on the forklift.
