North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)jobsite - the employer failed to ensure that employees lock the locking pin on the mobile home's hitch which would have secured it to the totter's hitch and prevented the mobile home's hitch from falling off the totter's hitch and striking an employee, on 14 May 1998. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to lock the locking pin on the mobile home's hitch each time it is connected to the hitch on totter.
