North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)jobsite - employees were working in the area underneath a Brigadier Homes of North Carolina 14' x 80' mobile home during set-up operations without the protection provided by the reinstallation of the wheels and axles creating a caught between/trapped under hazard for the employee working in the area, on 14 May 1998.
