Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Flagmen or other appropriate traffic controls were not provided to employees surveying on the Greater Cleveland Regional Transit Authority Redline Eastside Track Rehabilitation Project while train and heavy equipment traffic continued through the area. A flagman or other appropriate traffic controls, were not provided to protect employees from being struck. Feasible and acceptable abatement methods, include but are not limited to, providing trained and competent flagmen to warn of approaching track-run equipment and commercial trains in conjunction with providing radio communication capabilities between equipment operators and other contracting crews.cting
