Title 40.1-51.1,(A),Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that: The driver of a motor vehicle, a Model D350E Caterpillar Dump Truck, had a suspended Virginia Driver's License while operating the dump truck on the Bethel Landfill job site in Hampton, Va., which could endanger the life of the other employee working in Cell 1-B. One feasible and acceptable method, among others, to correct this hazard is to adhere to the Exposure Control Plan of H. E. Sargent, Inc., page 13, section #19, "All employees who drive vehicles or operate equipment shall be required to hold a valid operators license issued by the state of residency and appropriate for the class vehicle being operated or driven".
