NYSLL Article 2 Section 27 a(3)(a): "General Duty Clause" New York State Labor Law, Article 2, Section 27-a(3)(a) - "Every employer shall: 1) furnish to each of its employees, employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees; and 2) comply with the safety and health standards promulgated under this section. In applying this paragraph, fundamental distinctions between private and public employment shall be recognized." a)New York City Transit Authority. The employer must continue training its' employees; and, retain those that show a lackadaisical attitude towards employee safety and safe practices. Supervisors, track crew leaders and employees must be made aware of the dangers when their attention is diverted to another area. Or, when the flaggers are taken from their assigned spots and given another duty; that they should be replaced by another person to watch for approaching trains.
