Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential electrocution during pole setting operations due to the installation of the pole ground in excess of ten feet above the ground (earth): Kents Hill Road, Mt. Vernon, CMP pole #102 - During pole setting operations on 9/11/97 at approximately 9:30am one of two linemen was electrocuted due to contact of the pole ground with the field phase primary which was approximately thirty feet above the ground (earth). Among other methods, one feasible and acceptable abatement method to correct this hazard is to limit the installation of pole grounds to no more than ten feet above the ground (earth) during pole setting operations.n
