Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries resulting from machine runaway due to the vehicle being started while the operator was standing on the ground: a) J M General Contractors - An employee started the John Deere Backhoe (Serial #2765656T, Model #JD300-B) while standing on the ground. On or about 9/15/98. ABATEMENT NOTE: In Accordance with 29 CFR 1903.19, Abatement Verification, the employer will furnish certification that the described hazard has been abated. Documentation may include but is not limited to photographs, videos, work orders, invoices, training records and consultant reports. Abatement documentation must be received by the Area Director within 13 calendar days of the final abatement date for this violation. NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is for the employer to adhere to the manufacturers safety rules by prohibiting the starting of the excavating vehicles' engine from any position other than the operators seat.tors
