Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupation Safety and Health Act of 1970: The employer did not furnish employment and a place of employment, on or about November 15, 1996, and at times prior thereto, which was free from recognized hazards which were likely to cause death or serious physical harm to employees where employees were exposed to falls and were not provided with ladders and the company did not enforce the use of those ladders during the performance of stocking operations on the top shelf of the storage rack in the warehouse. Among other means, one feasible and acceptable method to correct the hazard is to enforce the Sears safety Program which states, "Authorized ladders or platform stepstools must be used to retrieve items above shoulder height. NEVER climb the racks or shelving." and "Do not use chairs, tables, desks, storage rack or boxes in place of ladders."
