Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a recognized hazard of being struck by an overhead load: a) Cornerstone Concrete, Inc. & 451 E. Wonderview Ave., Estes Park, CO: On or before 11-06-97 the employer did not ensure that a Swing KVM 32 concrete pump truck was set up and operated at a safe distance from the edge of a 6'8" deep, vertically walled excavation. The left front outrigger of the pump truck was placed within 5 feet of the edge of the excavation. The face of the excavation caved in, causing the outrigger to sink. The horizontally extended boom of the pump truck fell, striking and fatally injuring an employee who was working underneath the boom. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the industry guidelines and set equipment back from the edge of an excavation at least one foot for every foot of vertical drop in the excavation.
