Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)On or about November 18, 1998, the HEK MSM 1000 mast climbing work platform with two employees on it fell approximately 60 feet to the ground when the platform was operated beyond its support mast. The employer did not ensure that the limit switch actuating rail (or red painted top mast) was installed. Before operating the platform, the employer did not correct problems, such as the absence of safety devices (red painted top mast) and the lack of marking or labeling of the controls to indicate their function. The employer also did not have records of the persons trained to operate the platform, and of the frequent and annual inspections of the platform. One feasible abatement method to correct this hazard is to comply with the erection, inspection, maintenance, operation and record retention requirements of the manufacturer's manuals regarding this platform, and the "Manual of Responsibilities for Dealers, Owners, Users, Operators, Lessors and Lessees of ANSI/SIA A92.9-1993 Mast-Climbing Work Platforms."
