Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling when accessing the elevated area to retrieve equipment. A.) At the jobsite; near Column P-19 in the gym area, on or about 06-17-1997: Employees walked on and "cooned" steel instead of using a ladder, scaffold or scissors lift while retrieving equipment that was stored on a 13' 7" high beam. Among other methods, one feasible and acceptable method to correct this hazard is to provide and use ladders, scaffolds, or scissors lifts for access to elevated work locations. OR IN THE ALTERNATIVE: 29 CFR 1926.1051 (a): A.) At the jobsite: near Column P-19 in the gym area, on or about 06-17-1997: No ladder was provided or used by employees retrieving equipment from a steel H-Beam that was 13' 7" high.
