Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of crushing injuries from train collisions. (a) Location - West Tunnel, Framingham, MA: On or about May 11, 2000 employees were injured in a collision between a train transporting concrete and a train transporting employees traveling on the same track in opposite directions. Among other methods, one feasible means of abatement could include: 1. Develop and implement adequate written traffic control procedures for trains transporting employees and/or concrete inside the tunnel. 2. Ensure that all employees engaged in this operation receives adequate training in these written procedures.
