Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a. On or about June 4, 1996, polyvinyl chloride (PVC) pipe and chlorinated polyvinyl chloride (CPVC) were allowed to transport compressed air at a line pressure of 85-90 p.s.i. to a 1000 gallon polypropylene acid batch treatment tank for the purpose of mixing. Fragmentation of the pipe may occur due to fatigue caused by cold contents and/or ambient temperatures or non compatibility of the pipe with its contents. Among other methods, one feasible and acceptable abatement method to correct this hazard is to insure that PVC or CPVC pipes under pressure are completely enclosed in a conduit or shatter resistant materials or use Acrylonitrile-Butadiene-Styrene (ABS) which is a plastic approved for compressed air supply.
