Text For Citation: 01 Item/Group: 002 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being struck by a vehicle. On or about April 15, 1998, the employer did not ensure that "team drivers" adhered to the requirements outlined in the Texas Transportation code TRC 521.222 sub paragraph D, sub section 2A which addresses the responsibilities of "Permit" drivers. The employer failed to adequately train permit drivers in the requirement that a permit driver drive a vehicle only when accompanied by a licensed driver qualified to drive that type of vehicle. One feasible and useful method of abatement would be to train team drivers/ co-drivers on the requirements outlined in the above Texas Transportation code.
