Text For Citation: 01 Item/Group: 001A Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about September 29th, 1999, at a site northwest of Valley City, North Dakota, off County Road 19, an employee was exposed to a serious hazard while unloading the Caterpillar road grader, Model 140G, from a flat bed trailer onto the road and near the railroad tracks. Seat belts were provided in the Caterpillar grader but were not being worn by the employee prior to being struck by the Canadian Pacific Railroad engine #CP9619. Among other methods to correct this hazard, one feasible method would be to instruct/train the equipment operators/haulers in the use of seat belts.
