Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Pedestrians were exposed to the hazard of being struck and/or locomotive operators were exposed to the hazard of striking objects on or adjacent to the tracks in that the stopping distance of the locomotive exceeded the distance illuminated by the low beam lights. On or about 12-13-97, the high beam headlights for locomotive #900457 were inoperable. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair the high beam headlights as required by the Federal Railroad Administration 49 CFR 229.125(b)."
