Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple crushing injuries: (a)Warehouse area - On 6 May 1997, operator of forklift # 33 was not wearing a seat belt. (b)Warehouse area - On 6 May 1997, operator of forklift # 32 was not wearing a seat belt. (c)Warehouse area - On 6 May 1997, operator of forklift # 26 was not wearing a seat belt (first instance for this operator). (d)Warehouse area - On 6 May 1997, operator of forklift # 26 was not wearing a seat belt (second instance for this operator). (e)Warehouse area - On 6 May 1997, operator of forklift #22 was not wearing a seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce and require industrial truck operators to wear their seat belts.
