Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Garden of Love grave site on 5755 Mallory Road in College Park, Georgia: Employees were exposed to pinch point hazards while using the Bradco 6LD backhoe to dig graves at the grave site. (On or about December 8, 1998) One or more feasible and acceptable abatement methods to correct this hazard would be to: 1) Provide adequate training for mounting and dismounting 3 point hitch backhoes to tractors or other equivalent equipment in accordance with the Three Point Hitch(Type A) Backhoe Personnel Protection - SAE J1518 June 86 recommendations and/or with the ATI's (American Trencher, Inc) manual. 2) Require the use of safety chains on the Bradco backhoe while in operation to avoid hitch failure or upward movement of mechanical components. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
