Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling and/or being caught between and/or struck by falling equipment and building debris. Steel beams near the west wall which initially connected the State Theaters' western most roof truss to the theaters' west load bearing brick wall, had been cut before all of the remaining concrete at the roof level was removed, causing the western most roof truss and the west load bearing wall to collapse prematurely. One feasible and acceptable method of abatement would include the removal of the entire concrete roof slab, before cutting the support beams spanning between the western most roof truss and the west load bearing wall. and/or in the alternative: 29 CFR 1926.858(d): Structural member(s) being dismembered were overstressed; a) Demolition site - State Theater, 2844 Kennedy Blvd., Jersey City, N.J.; Employee(s) working on a tubular welded frame scaffold next to the theaters' West load bearing wall, were exposed to the hazard(s) of falling and/or being caught between and/or struck by falling equipment and building debris. Steel beams near the west wall which initially connected the State Theaters' western most roof truss to the theaters' west load bearing brick wall, had been cut before all of the remaining concrete at the roof level was removed, causing the western most roof truss and the West load bearing wall to collapse prematurely. Violation occurred on or about 1/19/98.
