29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Falcon Forming, Inc., @ 8161 E. 33rd. Ave., Denver. CO: On or before February 21, 2012, the exposing employer did not ensure that daily inspections of the excavation were made by the competent person for evidence of a situation that could have resulted in a possible cave-in that, the excavated spoil pile was not kept at least 2 feet from the edge of the vertically-walled excavation at the north side, which measured depth was between 61 and 64, approximately 48 feet long and lacked any protective system, such as appropriate sloping, benching, or shield systems. This condition exposed employees to the hazard of the spoil pile falling into the excavation while conducting work inside in that section of the excavation.
