Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that they were exposed to an impalement hazard: a) At the construction site, employees were exposed to an impalement hazard from tripping and falling on unguarded protruding steel form stakes while walking and working around basement foundation footers. (a) Falcon Forming, Inc., @ 8161 E. 33rd. Ave., Denver. CO: On or before February 20, 2012, the exposing employer did not ensure each protruding steel form stake, which was being used to hold the footers in place, was capped or guarded to eliminate the hazard of impalement. This condition exposed employees to an impalement hazard. On February 20, 212 an employee fell into the basement foundation excavation and landed on a sharp protruding steel form stake, which was sticking out approximately 7 inches above the 2 x 8 wood form. The employee sustained a head injury resulted in his death. AND/OR THE ALTERNATIVE (a) The hazard of tripping, falling or come against unguarded protruding steel form stakes while walking and working around basement foundation footers created an impalement hazard to employees working at the construction site. Among other methods, one feasible and an acceptable method to correct this hazard: install protective caps over protruding steel form stakes designed by the manufacturer to prevent impalement or to use another equivalent means such as, pounding the steel stakes flush and level with the form or grade. Or use wood form stakes as an alternative method.
