Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Falls from elevations up to 36 feet due to not using outriggers on a Genie Personnel Lift, Model PLD-36, on or about 6/4/85 at the Wittner Center, St. Petersburg, Florida. Among other methods, one feasible and acceptable method to correct this hazard is to train and instruct any employees who may use the equipment in the mandatory use of the outriggers at all times that the equipment is in operation as is specified by the Manufacturer's Operating Manual.
