Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about August 9, 1990, employee(s) were exposed to the hazard of being struck by or knocked off the roof by an old exhaust blower stack when cutting the stack down and pushing it over the roof edge. One feasible and acceptable method of abatement to correct this hazard is to remove such stacks either partially or in total by means of a crane or other mechanical device to lower the stack or sections of the stack to the ground.
