Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. Ashville, Ohio, 10718 Winchester Road, crushing by crawlers due to inadequate training of crawler operators in the safe procedures for loading/unloading these machines onto/off truck trailers. Among other methods, one feasible and acceptable abatement method to correct this hazard is to devise methods and require testing in the safe operation of crawlers in accordance with the Construction Industry Manufacturers Association. These methods include but are not limited to: -----loading/unloading on a level surface; -----the trailer bed and ramps be kept free of slippery material; and -----operator wears a seat belt.
