Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards by a bull dozer: a.On or about October 4, 1999, bark pile, the Komatsu Avance bull dozer operator did not utilize the provided seat belt because it could not be fastened, exposing the operator to a crushing hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure conformance with the Komatsu Avance operations manual (see section 7.2 and 12.1.4). ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
