Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by a bull dozer: a.On or about October 4, 1999, bark pile, the employer did not ensure that the Komatsu Avance bull dozer operator was following recommended procedures specified in the owner's manual, and by not following these procedures, an employee was fatally struck by the bull dozer. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure conformance with the Komatsu Avance operations manual (see sections 7.2, 12.4 and 12.9.6). ABATEMENT CERTIFICATION IS REQUIRED.
