Text For Citation: 01 Item/Group: 001 Hazard: OTHER
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of drowning: a) the Pier 3 Apartments - Employee was placing refuse into a metal dumpster and fell approximately 7 feet 4 inches into the Delaware River. This resulted in a fatal drowning to the employee. Fatality occured 4/28/92 at 11:55 PM. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to install Ring Buoys with at least 90 feet of line that can readily be available for emergency rescue operations. This is detailed in 29 CFR 1926.106(c) and 29 CFR 1918.96(e).
