Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of trucks, with partially blocked visibility to the rear, backing up to loading docks, thus exposing pedestrian employees, in the vicinty of the loading docks, to being struck by moving vehicles. Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement a driver training program as outlined in the National Safety Council's publication "Motor Fleet Safety Manual" with special attention to the section entitled "Backing Accident Prevention" which states as follows: 1) Get out before moving and size up the situation. 2) Back from the driver's side. 3) Back slowly 4) Check both sides as you back, and 5) Use a reliable person to guide you.
