OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees such as unsafe racking systems: (a) 201-A Commerce Drive, New Holland, PA; Main Warehouse - On or about March 27, 2024, the grey lumber racking in front of the mezzanine did not have the load limit posted on or near the racking system, and had damaged racking components. Employees were exposed to crush and struck by hazards. (b) 201-A Commerce Drive, New Holland, PA; Main Warehouse - On or about March 27, 2024, the 5-tiered racking system where metal custom door hardware was stored was not anchored to the floor and did not have the load limit posted on or near the racking system. Employees were exposed to crush and struck by hazards. (c) 201-A Commerce Drive, New Holland, PA; Yard - On or about March 27, 2024, the 4-tiered racking system did not have the load limit posted and was not anchored to the ground. Employees were exposed to crush and struck by hazards. (d) 201-A Commerce Drive, New Holland, PA; Building B - On or about March 27, 2024, the Blue and Red rack did not have the load limit posted and was not anchored to the ground. Employees were exposed to crush and struck by hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
