OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: in that employees were exposed to struck-by and crushing hazards. a. Interstate 280 Westbound, Exit 13, Bridge shoulder, Newark, NJ On or about January 10, 2024, employees of Joseph M. Sanzari Inc. were exposed to struck-by and/or crushing hazards while working near and around a Caterpillar 321 track excavator, S/N MPG00535 while removing the concrete parapet of the bridge. Employees were working in the operator's blind spot, in a narrowed work zone where the configuration of the work area did not allow for the swinging of the cab and the excavator was limited to being operated only in forward and reverse.
