Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing jobs duties. a) On or about and at times prior to September 13, 2023, employees were exposed to the hazards of high heat from direct sunlight during the performance of their duties including planting sugarcane for 5-7 hours. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 24? to 31? (76? to 87?) while working outdoors performing light to moderate manual labor and wearing long-sleeve shirt, jeans, boots, handkerchief, and hat. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. An employee experienced heat stroke during the course of his duties on or about September 13, 2023, and the employee subsequently died.
