29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) 30 Wilson Avenue, New Square, NY: On or about 5/31/23, employees used an extension ladder to access the roof level from the ground level and the ladder did not have side rails which extended 3 feet above the upper landing level being accessed. b) 50 Wilson Avenue, New Square, NY: On or about 6/7/23, an extension ladder was used by an employee to access a 3rd floor wall opening from the ground level and the ladder did not have side rails which extended 3 feet above the upper landing level being accessed. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
