Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where employees were exposed to entrapment in temperatures below the freezing point: On or about May 11, 2023, at Arby's restaurant located at 1120 East Admiral Doyle Drive, New Iberia, LA; employees were exposed to the recognized hazard of entrapment within the freezing temperatures of the Polar King walk-in indoor freezer, Model HL1216 where the freezer was not capable of being opened from inside the freezer. The hazard of sub-zero temperatures were capable of causing hypothermia, frostbite, and death.
