29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a. The employer does not ensure employees on a on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level are protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. This violation was discovered on or about January 10, 2023; on the second floor perimeter, where employees stood and walked near the edge of the second floor, and were exposed to fall hazards. b. The employer does not ensure employees on a on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level are protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. This violation was discovered on or about January 10, 2023; on the second floor above the stairway opening: where employees were cleaning, and moving supplies and equipment near the edge of the stairway opening, and were exposed to fall hazards. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the requirement, including describing the steps that it is taking to ensure employees on a on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level are protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.
